General Terms and Conditions of Sale
These General Terms and Conditions of Sale govern the access to, browsing of, and purchase of products offered on the official BRAMIER website (hereinafter, the “Site”).
By using the Site, you fully accept these terms and conditions. BRAMIER reserves the right to modify them at any time; updated versions will become effective from the date they are published online. Continued use of the Site after such updates constitutes acceptance of the revised terms.
The online sales platform is provided by Shopify Inc., which enables the technical management of the e-commerce service.
1. USE OF THE SITE
The user declares that they are of legal age according to the laws in force in their place of residence or that they are browsing under the responsibility of an adult.
It is prohibited to use the Site or BRAMIER products for unlawful, unauthorized purposes or in violation of any applicable laws. It is also prohibited to distribute viruses, malicious code, or content capable of compromising the security or proper functioning of the Site.
BRAMIER reserves the right to suspend or terminate access to the services in case of improper use.
2. TERMS OF SERVICE
BRAMIER may refuse or interrupt the service, even without prior notice, where legitimate reasons exist.
Information transmitted through the Site, except for payment data, may be transferred across different networks and adapted to specific technical requirements. Payment-related data are always protected through secure and encrypted systems.
Any unauthorized use of the Site’s content or functionalities is strictly prohibited.
3. CONTENT AND INFORMATION
BRAMIER strives to ensure the accuracy of the information provided on the Site; however, occasional inaccuracies or delays in updates may occur regarding product descriptions, prices, or availability.
BRAMIER reserves the right to correct, modify, or update such information at any time, without prior notice, in compliance with consumer rights.
4. PRICES AND AVAILABILITY
All prices are expressed in euros (€ or $) and may be subject to change.
Product availability is not guaranteed on a continuous basis. If a product becomes unavailable after an order has been placed, the customer will be informed and refunded without undue delay.
Any modification, suspension, or interruption of the Service does not entail liability for BRAMIER.
5. PRODUCTS
Products are described in their respective product pages with information and images for illustrative purposes. Minor differences in color or details may depend on the display settings of the device used.
BRAMIER reserves the right to limit purchase quantities, sales areas, or customer categories, as well as to modify product descriptions and prices.
6. ORDERS
Submitting an order constitutes a purchase proposal. The order is considered accepted only upon the sending of the confirmation by BRAMIER.
BRAMIER may refuse or cancel incomplete, unusual, or incorrect orders. The customer is responsible for the accuracy of the information provided at the time of purchase.
7. PAYMENTS
Payments must be made through the methods available on the Site. All transactions are processed through secure payment systems.
BRAMIER does not directly store payment card details.
8. THIRD-PARTY SERVICES AND TOOLS
The Site may integrate third-party services or applications. BRAMIER does not exercise any control over such tools and assumes no responsibility for their use.
9. EXTERNAL LINKS
Any links to external websites are provided for the user’s convenience. BRAMIER is not responsible for the content, accuracy, or damages resulting from access to such resources.
10. USER CONTENT
Comments, reviews, or communications sent to BRAMIER may be freely used for informational or promotional purposes.
BRAMIER reserves the right to remove content considered inappropriate or unlawful. The user guarantees that they have the necessary rights to the submitted content.
11. PERSONAL DATA
The processing of personal data takes place in compliance with applicable laws and is governed by the Privacy Policy available on the BRAMIER Site.
12. TAXES AND DUTIES
For orders placed within the European Union, prices include applicable VAT.
For shipments to countries outside the EU, any customs duties, taxes, or import charges are the responsibility of the customer. In the event of non-payment of such charges, any refund will be issued net of the costs incurred.
13. SHIPPING AND DELIVERY
Products are delivered to the address provided by the customer at the time of the order through couriers selected by BRAMIER.
Delivery times are indicative and may vary depending on the destination, product availability, or periods of high demand. It is the customer’s responsibility to check the integrity of the package upon delivery and promptly report any issues.
14. RIGHT OF WITHDRAWAL
The customer has the right to withdraw from the contract within 14 days from the date of receiving the products, without providing any reason.
The withdrawal request must be sent by email to info@bramier.com. Products must be returned intact, unused, and complete with their original packaging.
The refund will be issued after the return has been received and inspected, using the same payment method used for the purchase. Customized products or products made upon specific customer request are excluded from the right of withdrawal.
15. PRE-ORDERS
Some BRAMIER products may be offered as pre-orders, allowing customers to reserve an item that is not yet available in stock but currently in production. In such cases, delivery times differ from standard shipping times and are indicated on the product page or collection page. The indicated dates are estimates and may change; any updates will be communicated promptly.
Before completing a purchase, customers are invited to verify whether the product is available for immediate shipment or offered as a pre-order. Once the order is confirmed, the customer will receive a confirmation email summarizing the purchase.
It is possible to request a modification of a pre-order only for a model belonging to the same collection, subject to availability. Once the item has been handed over to the courier, modifications will no longer be possible.
If an order includes both available products and pre-order items, the products in stock will be shipped separately according to standard timelines, while the pre-order item will be shipped as soon as it is ready.
The pre-order may be canceled free of charge within 24 hours of purchase confirmation, with an immediate refund after cancellation confirmation. After this period, it will no longer be possible to cancel the order before delivery, as pre-orders allow BRAMIER to plan production and allocate materials and resources. However, the legal right of withdrawal remains valid and may be exercised within 14 days of receiving the product.
16. LEGAL GUARANTEE OF CONFORMITY
All BRAMIER products are covered by a 24-month legal guarantee of conformity, in accordance with applicable laws.
The guarantee does not cover damage resulting from improper use, unauthorized modifications, or normal wear and tear. Any defects must be reported by contacting Customer Service at info@bramier.com.
